Court Disappoints Residents Battling Verizon Cell Towers
Earlier this week, the Children’s Health Defense exposed how Massachusetts residents who alleged a Verizon tower near their homes is making them sick can’t get relief through the state or local court system. Instead, they must seek a remedy at the federal level, for example, by bringing their complaint before the Federal Communications Commission (FCC). However, Attorney W. Scott McCollough, who has challenged the FCC on this issue previously and in fact won against them in court, has said that’s not a realistic solution. The local health board initially sought to protect the residents by issuing Verizon a cease-and-desist order. However, when the issue went to state court, both the lower and higher courts ruled that local health authorities cannot intervene when a cell tower is making people sick, as long as the tower complies with the federal radiofrequency (RF) radiation limits set by the FCC. “It is a gross miscarriage of justice that a board of health has no power when people are being sick and injured by a cell tower,” said plaintiff Courtney Gilardi, a mother who said her family became ill and had to move because of Verizon’s tower. Meta Fined £421 million in Largest Child Safety Ruling
A US judge in New Mexico has ordered Meta to pay another £421 million in damages for its failure to warn the public about dangers its platforms posed to children, marking the largest against the company over child safety. The Judge compared Meta to a factory, with advertising and content as its product and “the psychological harm and sexual exploitation of children to be the pollution that must be abated”. The company Meta disagrees with the ruling and will appeal the decision, stating they “work hard to keep people safe on our platforms”. Notably, this fine is tiny compared with their $61 billion in revenue from April to June 2026. However, “it’s an indication that we are moving to a stage where social media is going to be tackled around the world,” said Bruce Daisley, a former European vice president of Twitter.
Consumers Rights to Know About Radiation Concerns
The Director and co-founder of the Radiation Research Trust, Eileen O’Connor has published an encouraging post showing how Italy’s Supreme Court has delivered an important ruling that could have significant implications for consumer protection and manufacturers’ information obligations. A woman challenged Apple over the lack of information provided about radiofrequency exposure from mobile phone use. The case was brought and argued on two fundamental principles:
1. that consumers must have access to relevant information in order to make informed choices
2. the right to know must be supported by effective legal protection when that right is denied.
The scientific evidence presented during the proceedings was important in forming the decision. Fabio Cardanobile the lawyer who fought the case said: “Big Tech manufacturers must now take [this] seriously: if they fail to inform, they can be made to pay, potentially to millions of users. This is, I believe, the aspect that gives the ruling its true global significance”. The decision highlights an important principle for technology companies, regulators, manufacturers, the media, and governments: scientific uncertainty should not be used as a reason to withhold relevant information from the public. The full official English translated text of the judgment is available within this write up.
